By accessing or using TechFnatic Labs Private Limited's ("TechFnatic," "we," "our," or "us") services, including ERPEasy, EstimatEasY, and MarketingEasy (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

TechFnatic provides cloud-based Software as a Service (SaaS) platforms designed for:

• ERPEasy: Construction operating system with integrated modules for project management, marketplace, talent management, and customer relationship management
• EstimatEasY: AI-powered cost estimation and quantity takeoff platform
• MarketingEasy: Marketing automation and campaign management platform

3. Account Registration and Security

3.1 Account Creation

To access our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHFNATIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TechFnatic, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.

12. Termination

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your access to the Services will cease at the end of your current billing period.

We may suspend or terminate your access immediately if you violate these Terms, fail to pay fees, or engage in conduct that may harm our Services or other users.

13. Governing Law and Disputes

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India. We encourage informal resolution of disputes before formal proceedings.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Services or via email. Your continued use after changes become effective constitutes acceptance of the modified Terms.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and TechFnatic
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
